I have been working for a company from 2002, my first H1 visa was valid from Jan 2003 to Dec 2005.
I applied my extension under the same employer in Nov 2005, my employer received the receipt of receiving the application. But in may 2006, USCIS had asked $1500 fee and we filed it immediately. This extension would be valid from Jan 2006 to Dec 2008.
Now i am waiting for this extension to be approved.
Mean while i have an offer from other company and would like to take the offer. The new employer has accepted to do all H 1 b procedure.
But my question is, can I take this offer and apply for H1 b without getting the approval of my previous filing.
or what is the best way so that i can take this new offer. Please reply back.
