Hi,

we both got our biometric code 3 appointment notice and it is in second week of february.We alreadey went for finger printing first time in february 2004. My wife is at present in India and she has not planned to be back until july 2006. My lawyer suggested that if my wife doesn't want to travel then i can go for my biometrics alone in february and he can ask the texas service center to give my wife's biometrics date sometimes in july when my wife is in USA.I'm from India EB3 category priority date march 2003. GURUS please let me know.what should I do?

(1)Is it worth spending thousand dollars and call my wife from india especially for this biometric appointment?

(2)Can we reshedule and get a biometric date after 6 months sometimes in July or it will be too long time for rescheduling the appointment date?

(3)If i go alone for biometrics without my wife just in case she can't travel then our greencard petitions won't be processed togather as they are doing it now?

Gurus please reply asap because i have to make a decision asap either to book ticket for my wife or reschedule our appointment.

Hello, here is my few pennies worth suggestion:

Yes. You have been waiting almost 2 years. You don't want to get in any kind of trouble.

(2)Can we reshedule and get a biometric date after 6 months sometimes in July or it will be too long time for rescheduling the appointment date?
You can reschedule. But is it Aos or Consular processing. Don't give any room for uscis to speculate.

(3)If i go alone for biometrics without my wife just in case she can't travel then our greencard petitions won't be processed togather as they are doing it now?
My suggestion is bring your spouse and get it over with. Unless otherwise your spouse has any medical emergency. If your spouse is vacation, they will delay the process. Unless there is a valid reason don't postpone.

My wife's studies are going to be over after 6 months and then she is planning to join me in usa. i'm laid off from my project last month and on bench now. My lawyer is suggesting me that if i want to save money then i can request service center to reschedule my wife's biometric appointment after 6 months.He will write that request letter for me.

My questions are..

(1)my case is not consular processing.asking 6 months time for rescheduling biometric appointment can raise suspcision?

(2) being from India EB3 category priority date march 2003, it seems like couple of years to get my GC.Then why they are sending this biometrics code 3. isn't the biometric code 3 generally done after 485 is approved. Does this biometric notice mean that my case is almost done and they are gathering all the final remaining documents?

(3)My biggest dilema is that whether i should call my wife especially for this biometric appointment or not..seeing this retrogression mess i feel that there is not going to be any positive news for a while and I shouldn't waste any money and give trouble to my wife and family. But ever optimistic person inside me tells me that as i've already spent thousands of dollars and precious years of my life for GC then i better waste some more and call my wife. I don't know what to do.this gc struggle,frustration and wait has totally ruined my mental peace.

Time is running out for me and i've to make a decision.all the Guys who can put your feedbacks please help me out and give me your valuable suggestions.

Noone could know this. Noone could read USCIS mind, but if that is a good reason, I don't think any issues could happens. But of course, they might not reschedule 6 months later (may take longer time or forever...)

Not really, I received code 3 FP right after few weeks of applying concurrent.

Like I said, it is up to you. If you want to pass this and add more complication into the GC process, it is fine.
But, it is not a big problem IF USCIS received the rescheduled letter BEFORE THE finger print DATE and you MUST MAKE SURE THAT HAPPENS. Or, I don't know any consequences (They may assume you abandon your I485. Then you need to appeal, but your wife AP may be voided)
Just FYI, I got LUDs on the same day of finger print code 3 and the day after that day. That means USCIS CHECK for those finger print, so the letter must be on their system before the time they check
