One of my neighbor was picked up by DHS.
He is an illegal alien. He was riding in a car with a friend and freind's dad who happened to be speeding.
He has no prior charges or felony or misdeamonor in his record.

He turned 18 last month. But he has been in the US for 4 years now.
My question is if he pays to get "Voluntary Deportation" and leaves for Mexico -
will he be able to come back anytime soon under student visa or some other visa?

I am aware that over 1 year stay = 10 year ban.

In this case, since he turned 18 (adulthood) not even a month ago - is there any liniency regarding the 10 year ban????

He has 180 days from turning 18 before the 3 year bar kicks in. Since it is less than a month since he turned 18 he or lawyer can ask for voluntary departure and he gets it must leave as soon as he can so he will not get barred. All the illegal presence when he was a minor doesn't count. It will be very difficult for him to return in any non immigrant status.

TY soo much for your response. He did go infront of a judge and got voluntary departure granted. He will be leaving very soon. The judge also removed the deportation from his records. Will he have any chance returning as a student? If not, what is his best course of action??!!!

Once again thank you soo much for your prompt response.

It does not look good for him at this moment. If he has a USC girlfriend and they are willing to get married thats an option. Otherwise having been here for 4 years illegally even as a minor is or can be construed as immigrant intent if and when he applies for any non immigrant visa. Also it is unlikely that he has strong ties to mexico which will also be a negative factor. So basically if any of his parents can become a USC or obtain legal status before he turns 21 then there might be a chance for him to get a derivative green card.
