urgent--visa got rejected--please help

I applied for a status change from H4 to F1. I filed an I-539. I got the receipt for my visa on May 14. I turned 21 about a month later on in july. On september 2, I got my visa rejected and the reason that they gave was that my status was not leagal between my birthday and september 2.

My question is , when you apply for an I-539, is'nt your status leagal when the application is being processed, even though you turn 21 ?? Has the INS made a mistake??????

seems you are student on H4 dependent(Child) visa.And you have applied fro F1 well before 21st birth day.It is the CIS who took the time to process.
It may be better,You may consult an attorney to give a strong rebuttal to CIS to avoid any risks of not getting or further time dealy in getting your F1, so that your studies are not interrupted.
