Hi everybody,
One of my friend's h1b status has expired last tuesday but his I-94 says his visa is upto June 2005. His employer is going file for the extension this tueday(monday is holiday) through premium processing. He is worried what happens to his case. His employer's attorney says there is a 30 days grace period and may not be any problem. My friend is working and having recent pay stubs too.
Please tell me is there going to be any problem for his stay.

this really is a stupidity from his side but what to do.
good thing is, he is been working in a govt organization as a consultant for the last 6 months
 
There's not much he can do now, so ask him to chill. File for renewal, and enjoy life. Chances are INS will never notice.

Well technically he got out of status the moment his H1b expired. I know it is ridiculous, but the interpretation of grace period changes from officer to officer. He'd be back in status once his h1 is filed. My guess is that, the worst that might happen is that in his H1b premium processing, he might get an RFE, but eventually with company's requests etc. he will get his H1b. Obviously if his case gets assigned to an officer who hasn't gotten laid for the last 3 months, he could even be rejected, but chances of that are pretty low (ins officers are pretty .. laid back !!??).

Again, when he tries applying for GC, whenever that will be, he again might run into the same situation.

In short, 99.9999% he will be okay. His chances of RFE are high though, but not a big deal, he most probably should get his renewal.

Advice for him, be very very friendly with your company for the next few days, you might need them to bend way out of their way to get your case thru.

Well his employer is his cousin so he might not get the problem from his employer's side. Only concern is first to get the damn extension. After that lets see GC or anything. By then he would be matured enough not to take these kind of things easily.
Its really a callous and stupidity from his part. But what can we say? Some times people learn things from the harsh experiences they face and have to face.
Am I right!?
The thing is he is still having a project for next 6 more months in a govt organization where he is been working for the last 3 or 4 months. He is drawing good salary and timely pay stubs.
Finally what is RFE? Hope thisn't a silly question

I did't get one thing his H1b expired then how did he had I94 till 2005. That means he's on some VISA which is valid till 2005. So question of out of staus does't exist. So only thing he might have violated is work without authorization so do't get paid for that period . Since employer's is on his side they can change the things and file the new H1 extention and get paid later.
There's nothing to worry about even for GC Max u might have to pay $1000 penalty.

Anyways, RFE = Request for explanation, where an INS offr. has a question and he asks you for more information.

About why I-94 is valid till 2005, well .. because someone at the airport didn't think properly before marking a date on it. it happens more often than you think, look at your Drivers License, is it valid beyond your h1b expiration? 50/50 bet .. it is.
 
exactly. he got h1b visa in madras upto july 2005 even though his h1b permit is till nov 2002 and at the port of entry (detroit), the officer gave him same time period on I-94, i.e july 2005.

well thanks guys. appreciated. hope my friend will be happy and releived from his tension. the problem is he never discussed these things with us, and finally he came out. well I am doing my level best to gather all the necessary information so that he would be living in peace till he confirms his extension.
his employer is cousin so they will do their level best.
one final question, if he doesn't get extension, can he jump into any school immediately? or any other thing where he doesn't get deported to India.

Yea if he doesn't get approved, he can jump into a school, which in my view needs F-1 Visa, for which you need an I-20, which takes time (and money), and thats harder to get than H1, and you can't work on that.

Your friend is really shy, he needs to come forth and discuss these problems more openly.

Man I wish I had a guy like you helping my life out. Dirty laundry is taking over my apartment ...

1. wear use and throw clothes
2. there must be a lot benchers out there in calif. why don't u ask them to start a dirtylaundry,Inc. company so that they can laundry clothes of people like u who r busy for some money?
3. cross dress and lure potential customers to clean out ur laundry
