Hello:
I filed my I485 in 01/31/2002 and got my ead card and finished my FP. I have been with my company for 2.5 yrs now

My company filed for bankrubpcty in last Aug 2002. They are going to be out of business by Mid of Dec 2002.
They sent termination letter to me since the company is no longer open. I can join another company now.

My question is:
Is it a problem with INS because my 1st company closed?
Is it a problem joining another company?
 
i don't think

you r safe as you have crossed 180 days and if the company is getting closed then its not your fault then why should INS object your case. Enjoy the time you r fine.

This is just my personal opinion.

As you have already crossed more than 180 days, you should be fine even if you change jobs. Only that the job has to be in the same or similar capacity.

Also maintain good relations with your present company(don't know how, as it's closing:)), at least request them not to go ahead with the withdrawing of I-140, etc.

The reason for this is because you don't want to stir a hornet's nest and cause a reason for RFE. Even if they do something likewise, you should not have a problem, as you will be using AC-21 to change jobs.

That's even better!!

You're covered by AC-21 since it's more than 180 days since you filed for your 485. You can join any company provided your job duties are same or similar to your previous one.

one good question is which one will keep the lawyer/attorney? :)

but before the company shuts down, make sure you get the copies of all the paperwork from your current lawyer. even if it is going to be your lawyer moving forward. it is impoertant to get the copies of the labor, 140, and copies of all 485 applications and make sure you get the original 485 receipt notice.
 
I have copies of i485 notice and FP notice AP notice and EAD card notice.

I doubt they will give me anything...
 
you are entitled to the copies of the labor and copies of the 140. it is a good idea to get them if you are changing employers. why do you think they will not give it?

Hi alphagc,

You have mentioned that you have a copy of I-485 receipt. That along with a copy of the Employer letter containing the job responsibilities and salary that your employer sent to INS along with the I-485 petition and a copy of the I-140 petition are the three documents needed by you to go forward from here.

If you have these three documents in place, I would suggest you go with a new attorney and have control over proceedings. If you have found a new job already, inform INS about your job change and cut off ties entirely with you old employer before he creates any problems...

I talked to my employer now and i think he is holding my file with all the originals. He promised he is going to send it next week.
Of course he will do this if I'm going to join him

The letter of Employment..

Hi alphagc,

One more thing is that you need a copy of the Employment letter that contains the Job title, job duties and salary that your employer had submitted to INS along with your I-485 petition.

With that you are all set to do things on your own.

I had a letter of employement when i join the company but i don't know if this was the one they used with INS or not

Hi alphagc,

The letter of employment given to us when we join the company is entirely different from what is presented to INS to get a GC.

So try to get a copy of the letter of employment that was sent to INS with your I-485.
That letter will be the basis of all future jobs that you do and communicate with INS..
