Urgent - Travelling on AP/Visa expired on Passport.

I'm planning to travel to Hungary on AP GOOD UNTIL 03/2006 (I-140 still pending and I-485 RD:01/07/2005).
I'm on a H1-B (8th year EXP:9/01/2005) status but Visa STAMPING on the passport EXPIRED
Do you think I can face any problems when re-entering the US with AP? Please advise me.

Hi Chinni11,

You can reenter USA with your AP but you need to look into other factors like your H1B extension is no longer valid and you need to work with EAD (i hope you have already filed it) and your EAD will be directly linked to your I485 petition .

also to work with EAD means you need to reapply every 8 - 9 months before its expires . but the date of validity is from the day its approved till exactly one year after .

for example : suppose you have your EAD till 03/2006 then you need to apply by Dec 2005 . if your are lucky (i have to say unfortunate ) then it may clear by end of Jan 2006 and will expire by Jan 2007 . unlike EAD approved before 2005 , the new EAD will not be issued from the date your old EAD expires ..
