Urgent Travel

Got the call we all dread about. My father is critically ill from what I am told a stroke. Talked to the family and things appear to be pretty bad. Here are the details:


TSC I-485 ND - 9/11/01.
3rd EAD (wife and I) expiring June 2004.
L1 (& wife's L2) valid until 10/1/2004
AP expired 11/12/03. Applied for new AP in June 2003, no approval yet.
Never changed employer.

Son was born in the US, but does not have a US passport. Son's particulars included in my wife's passport as accompanying child/minor.

Can the family travel without AP when L1 & L2 valid, I-485 pending, and on EAD, although never used EAD to change employer?

I plan to contact the attorney (Fragomen) tomorrow for advice.

Friends... I would appreciate any input/advice you can give me.

Since you or your spouse never used EAD and L-1 is still valid, you can come back to US WITH OUT any problems.
H-1 and L-1 are considered dual status visa, that remain valid even with I-485 filing.

Make sure take a letter from your employer saying you are on a temp visit/ training/ some family urgency to visit.

And one more thing, make sure you have to return before your Visa in the passports expires.
