Hi All

I have a question regarding travel to the Bahamas without a expired EAD. This is my situation:

I have a EAD which is expiring on the 5th of April 2005.
I have applied for a new EAD and the receipt has 22nd Feb 2005 on it as the date it was received by USCIS.
I have Advance Payroll document which is valid till 7th Sept 2005.
I have a H1-B document that is valid till 30 Sept 2006 but it is not stamped in my passport.

I need to travel to the Bahamas on 1st May 2005 and will be back on 5th May 2005. Will I have any problems entering the US? My lawyer says that I need to have a valid EAD if I am entering using Advance Payroll or H1-B stamped in my passport. My friends tell me that a valid Advance Payroll is good enough and they will not ask for EAD.

Please Help. This is urgent

EAD has nothing to do with AP. You can use your AP without an EAD. MY husband did and had no problem.

Should be no trouble .... you only need AP to re-enter.

If you look at the EAD card, it clearly says "Not valid for re-entry" :D
Plus, you don't need an EAD while on 485 (since you are not required to work while its pending)

So don't worry too much and take your AP and 'njoy.
