I have my H1B visa stamped by the name of my Previous Employer, which is valid, until Sept2005. Since I have changed my Employer the previous Employer have revoked his employment request from INS.
I got my H1B approved on the application of my New Employer in the mid of year 2004.
Now I am visiting my home country.
My question is can I return back to US using the H1B stamped for my Previous Employer’s name with no visit to consulate?
Some background conversation:
On my call INS office told I can travel if I have approved H1B of valid Employers petition (I129). (1-800-375-5283)
I called visa-issuing department too(1-202-663-1225). They told there that it may be tough to reenter US with Previous Employer’s visa & I need to get the employer’s name changed on my current visa.
The issue is even if I want to get the visa stamped, Consulate office donot have appointment available during my stay in my home country.
If it is needed then I may need to postpone my visit, which would be my choice of only crisis condition.
Plz let me know your experience if you have recently visited under such circumstances.
