Urgent: to refile or not to refile

Here is my case:

- From China

- RIR filed June 2001 and remanded and became non-RIR

- 6 year H1 expires May 2006

- No response so far from BEC

- Earliest possible date to refile is December 2005.

My company does not do multiple filings and does not recommend refiling PERM for my case, quoting risks of losing priority date in refiling and unabling to do 7 year extension.

I need to make a decision very soon. Thank you in advance for the advice.

You can try to convert old case to PERM for keeping the old priority day.
But I am not sure the approvement chance for this kind procedure in PERM.
