Hello,
My friend is travelling to India later this month. He is currently on H1. Entered the country on F1 in Fall 2003 for M.S. program. He has a visa interview on 6th Jan in Kolkata for stamping.
He hasn't finished his master's degree yet though he is working on the final project/thesis with his professor. It should be complete in Spring 2006. His attorney stated that it is OK for him to travel to India as the H1 petition they applied for him was based on his bachelor's degree from India. He works for a well known Internet company here now.
I was a bit uncertain about his attorney's recommendation as s/he probably doesn't know about stamping issues in India.
Can anyone recommend whether it is OK or not to go to India given the above situation. If yes, please let me know if he should carry any additional documentation stating that he intends to complete his degree. I have told him to carry a letter from his thesis advisor stating that he will return from India and complete his master's thesis.
Please let me know soon as his ticket is already booked and if we need to make changes, it will have to be soon.
