My employer filed for I-129 (H1B advanced degree quota) in April and my receipt is dated 04/26/2006(while I was still in OPT). My OPT expired in June and I applied for B2 (using I-539) to be in legal status after 06/19/2006 (OPT end date) to 10/01/2006(H1B start date). I got I-539 approved before I-129 got approved.
My I-129 is still pending and USCIS has updated my status with premium processing request when my employer filed for petition. Will I go out-of-status If I dont get my H1B approval before 10/01/2006(last date of B2 visa). I have already blocked the ticket to leave on 10/01. Everyones' suggestion will greatly help take actions accordingly. I am kind of undecided and scared in this kind of situation.
One other question, my employer filed H1B petition in April requesting a start date of 10/01/2006. Will my start date still remain 10/01, If I get the approval on, say, 10/10/2006 or will it be the date of approval (10/10/2006).
