Urgent: Salary difference question

Hello All GC Gurus,

I have following urgent question. Please let me know if any one of you faced such problem and did you successed in getting GC.

My H1 salary is: $56,000. Salary on Labour certificate that I used as substitute is $68K. My I-140 has been approved. My employer specified in I-140 petition that they will pay $68K. Now, I have consular interview. Employer has given me a employment letter stating they will pay me salary as specified in I-140 petition. They haven't specified amount in that letter.

Will this cause any problem because

a) My H1 salary ( $56K) is less than GC salary ($68K). But employer in the latest dated letter once again specified that they will pay salary as stipulated in the I-140 petition ( which is $68K) after approval of GC.

b) Does H1 salary needs to be same as GC salary? Even though GC is for future employment

Absolutely no problem. Since you got a letter saying that you
would be paid the stipulated salary after GC, you can go to the
CP without any worry.

Take my word, I speak from personal experience.

Having a current salary close to the promised GC salary is a good idea. You should be prepared to explain why you will get a 30% increase in salary only after GC approval, not before.

Thank you for the reply. You mentioned that you speak from personal experience. If you don't mind- Would you please let me know your case details? what was the detail situation? Did they ask you any question at the time of interview? and how did you reply/convince on salary difference question?

Hi Raju,

I am also in the same situation and I should get my I140 approved anytime in this month.
I would appreciate if you can send me the information for justifying the 30 % increase and convincing the consular with the facts and figures and also your suggestions.

My details are as follows,
Current Salary : $ 68 K
LC Salary & I140 : $ 90 K

Hi,

My GC labor salary is 30% less than what I actually make now. I have read in other posts that there will not be any problem if the current salary is more than the GC salary. My question is - Do I have to take any supporting docs to explain why my current sal is 30% higher now?

Appreciate any comments.

You don't need an explaination if your salary is higher then what is in LCA. This only shows how important you are to the company and indirectly to US economy.

Congrats on the big/fat raise and don't worry about the CP from this perspective.

I am currently paid 36K more than the salary in the LC. I came to know that Chennai Consulate is now asking for salary information.
I thought I could get my emplyer state that I will be paid a salary NOT LESS THAN <LC Salary>. My LC states 60K ,however I am paid 96K, I started at 78K and now at 96 K after several revievs/increments over the past 3 years.

Now, What should I reply to the officer, if asked about my salary?.

Please help guys

There is no problem for you. You don't have to , but if necessary
explain it as natural progression.

There is one aspect one should keep in mind. The consular officer should not get a doubt that the position you are in is not the same as the one mentioned in the LC. But if sufficient time has
passed between the time the LC has been filed and the present
date the increase can be explained.

They can think this way:

A position has been advertised with a low salary figure in order
to eliminate competetion and then is being offered to another
person at a higher salary. If this higher salary was mentioned
in the advertisements, may be some candidates would have responded.

But I don't think they are looking at things so closely.
