Urgent: Rush to RIR by 3/28, or wait for PERM ?

PLS HELP ME!

This is the situation; My company attorney and HR are rushing people to RIR by 3/28 because of the risk they see in PERM. I need to make a decision in days whether to request my long waited case in PERM.

1. I had waited 1+ yr for this PERM, without filing my GC with this company, hoping PERM gets faster
2. I was also promoted months ago to managerial position (exp BS+5)
3. My spouse RIR priority date is Oct 2004
4. We are from minor country so no PD issue
5. My company is concerned about denied by PERM based on the intensive recruitment effort needed

Can someone respectable/experience/did lots of research, pls give me an advice ? This ever trouble GC issue - is a life decision for us which will affect few years ahead. Your advice is deeply appreciated!

Agreed that there are issues and many unanswered questions with PERM at this moment. But that does not mean that those questions will never be answered and all the cases will be rejected in PERM. It is stupid to think like that.

I think since PD is not an issue in your case you could wait for few months to observer the implementation of PEM and then file your case in EB3 under PERM and you may get you GC we quickly based on where you file. Even if you file under RIR right now you are not going to see any LC approval for 1.5 to 2 years. Under PERM you may get the GC in 1.5 to 2 years. I think it is worth the risk.

This is my openion and I am not a lawyer. Seek professional advice before you make final decision.
