Urgent: Rfe Response On I-485

Hi All,

May 16th, I got a RFE on my I-485. USCIS sent this request directly to my lawyer. I called my lawyer couple of times and left a voice message and they did not respond due to filing new applications.

I called USCIS yesterday to send that RFE to my home address so that I know what is that for. USCIS officer told me that he can fax a copy of that RFE to me but he cannot send another copy to my adddress but he said that he can send another copy of the same to my lawyer once again.

I received the fax and the RFE is for submitting my latest EAD approval and my latest I-94 copies. I really wonder why USCIS is asking this since they have records to verify the same. This RFE is signed by one of USCIS Directors.

My question is: CAN I SEND THE RFE RESPONSE DIRECTLY TO THE USCIS? WILL THEY ACCEPT THAT?

SINCE MY LAWER IS BUSY IN OTHER ACTIVITIES I DON'T WANT TO WAIT FOR HIM TO ANSWER AND IT MIGHT DELAY MY ADJUDICATION.

Please share your experience and knowledge about handling this.

PD: Oct 2001 (EB3 - INDIA)
I-485 Filed - Dec 2003.
Name check cleared on March 2007. (FBI took 3 years 3 months to clear)
Did the latest finger print on April 2007.
Got RFE on May 16th.
 
Not sure if my reply will help you, but as far as I know the RFE notice clearly states that send the response with this original RFE letter on top and in the pre-addressed envelope to avoid further delays and your response getting lost. So if you can pick that up from your lawyer and you have the docs (EAD, I94) I guess you can send them yourself to avoid the delay!:cool:

Btw, just curious were you RFEd for the TB test too or just this?

I am not asked for TB test. They ask only current EAD and I-94 Copy.

My Lawyer is busy in filing new cases rather than working on the cases they filed earlier since the new filing fetch them more money.

We are all stuck with USCIS first and then lawyers... everyone is testing our patience here...

You better wait for your lawyer. My suituation is the same as yours. Nothing we can do except waiting for the lawyer's free moment for our case. My lawyer is very slow too. Not just your lawyer.
