I see the following change in online case system today on my case:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: We mailed you a notice requesting additional evidence.

On May 16, 2007, we mailed a notice requesting additional evidence and/or information in this case. Please follow the instructions on the notice to submit the evidence and/or information requested. This case will be held in suspense until we either receive the evidence or the opportunity to submit it expires. Once you submit the information and/or evidence requested, you will be notified by mail when a decision is made, or if the office needs something further from you. If you move while this case is pending, call customer service.

Priority Date: Oct 2001

1. Why they say the case will be held in suspense until they receive the evidence? - Is this common message they use for RFE?

2. Last August they told me that my case was in name check? does this RFE means Namecheck got cleared?

3. How do we respond to RFE? Through our lawyer or we can respond ourselves? This is the first time I am getting RFE on my I-485.

Please share your experience and knowledge on this.

Thanks much!

Hello javapoet
Don't worry seeing the word "suspend". Your case will be in hold
until the response to RFE is sent. But you HAVE TO reply to the
rfe with in the time frame they give you. The earlier the better.
IF YOU DONOT RESPOND IN THE TIME FRAME YOUR CASE WILL BE DENIED.

I'm not sure who will get the RFE in mail. Since you have an atty
in the file, most probably atty will get the RFE, I guess. If I were you
I would let my atty know the development. I would definitly consult
with atty.

Name check may or may not be cleared at this point of time. Sometimes
they will pre-process things even if security checks are not cleared. If your name check is cleared after the RFE is answered they will approve it.

Hope you will that beautiful welcome message soon!

By the way could you share your 485 application date and other details of your case? Did you originally filed to NSC or transferred to NSC from other service center(s).

Hi

It may well be your finger prints are out of date, The uscis computer system only holds records for 15 months

If you had a medical and it is past 12 months you may need another.

Do not worry, at least you know they are working on your case and it is not lost

Just wait and see what the referal is about

Sue:

Medical exam does not expire in 12 months ( at least not in practice). I know its supposed to - but I'm yet to see a case where they want a new medical.
Most 485s take more than 12 months easily !!

FPs do expire in 15 months like you correctly said -- however this case message sounds like an RFE for sure -- these days FP notices don't even change the case message anymore.

Any guess how long FBI name checks are valid?

thanks in advance.

Thanks a lot for everyone who took time and respond. This is the only way we all share these valuable experiences and helping each other...

Here is my dates:

1) I filed my 485 in 12/2003. My PD is 10/2001.

2) My case was transferred from CSC to NSC in Feb '07.

3) My last fingerprint was on 03/2007.

4) I did my last medical when I submitted my application back in Dec 2003.

What do you guys assume from this profile on my RFE?
