Dear Members,

I am currently in the US and I am traveling to India (Bombay) on an Advance Parole document that has been issued to me as an I-485 Pending applicant (family based petition). I will be outside of the US for a total of 32 days. I would like to know if there is any restriction that requires me to return to the US under 30 days when traveling on the Advance Parole document. I would greatly appreciate a response as I am only a day away from my scheduled departure. Thank you.

Read the AP carefully, see if it has any restriction etc. I doubt there is a 30 days restriction. You can come back anytime before the expiry of the document.

Thank You!

Goodsaint,

Thank you for your response. Are there any other issues you can think of when traveling on an AP document?

Looking forward to hearing back. Thanks again!

If you're working on EAD, take it with you just in case they ask you whether you have a job and how come you can work.
Make sure they take your I-94.
Otherwise, that's all. I've travelled on AP several times and never had any problems other than the delay at POE, which might be a nuisance if you're catching another flight - eg. coming from Santiago to Miami, continuing to SFO, they'll keep you waiting in Miami while the SFO plane gives a damn about you.

Thank You!

Dear Ruxrux,

Thank you for your advise. I am planning on taking all my documents with me. Also, my port of entry is Chicago and I am not continuing on further from there.

Thanks again!

As long as AP is not expired you dont have to worry about, this is what AP is all about! have a nice trip.

Final Confirmation

For anyone wondering about the issue that has been discussed so far, I did call the Immigration 800 number today and spoke with someone. The person mentioned that there is no limitation on the amount of time I spend outside the United States as long as I return to the United States prior to the expiration date mentioned on the the Advance Parole document.

I want to thank you all for your responses and advise.

I just came back from India on AP. At entry some dumb INS officer let me go directly to baggage claim without sending me to secondary inspection. Last time when I entered on AP I had to go thru secondary inspection. I asked her if I have to go thru secondary inspection. She said no. After collecting baggage when I was going out, I was told by a customs guy to go back for secondary inspection. He was surprised how I was able to collect my baggage without going thru secondary inspection.

In the end it was no big deal. Just a wast of time. Make sure you are sent thru seconday inspection when you arrive before you go to the baggage claim. Only passport and AP (original) needs to be presented. But keep other documents with you for peace of mind.
