Urgent Question on I-140

My RIR EB2 2005 is pending in Backlog.I got my PERM Aug 2006 labour approved.It's been close to a month.

Is it "not" a refile.RIR and PERM were filed with different requirements.So it's two separate labours.

So my attorney is waiting to get the RIR labour approved so that we can take advantage of RIR priority date.

My question is "Is it possible to file multiple I-140's"?
That is File I-140 based on PERM labour,then file another I-140 based on RIR labour when I get my RIR labour certified.
Is it possible to do that?

Also within how many days of receiving the labour certificate should the I-140 be filed?

Is the 45-day rule in effect(ie., I-140 needs to be filed within 45-days from receiving the Labour certificate)?

Yes you can file multiple I140 no problem with that. See my signature i did that recently.

Please can u tell after PERM labor approval how many days can i wait to file I140?And 2nd Q is i have a I140 only filed in EB2 category using a substituted labor with receipt date of FEb 27th ,2006 in TSC.The PERM approved labor is in EB3 category.Like u mentioned multiple I140s are allowed,but the concern for me is can i file this new EB3 ,PERM labor one in premium processing ?If i can in what way will my previous I140 be affected?

As far as what I heard is that for not the 45-day rule is not in effect ....so there is not limit on no of days.

But if somebody can confirm this it would be very useful for ppl having this doubt.

My lawyer told me that multiple I-140 is possible.
I have one EB2 RIR pending(March 2005) and PERM EB2 (Aug 2006) certified.
Now I dont know whether to wait for EB2 RIR to be certified and then file I-140 using the priority date March 2005 (or) should I go ahead and file I-140 For PERM EB2 AUG 2006 certified.

As of tractit.com,some March 2005 cases are getting certified.But some are still pending.It's so random.I dont know how to predict it and dont know how long should I wait.

Also I heard that I can file I-140 for PERM,then once I get my RIR EB2 certified, I can file another I-140 for PERM with priority date of the RIR(MARCH 2005) if the the two application has different work requirements(ie., if the two applications are different).

Does anybody know about this?

Answering second question first
Yes you can file EB3 PERM LCA in premium processing since it is your own.
Just to let you know that you can use premium process for your own LCA not for subsitution.

About first ques
I am not 100% sure some ppl says 45 days and somebody just mentioned that there is no limit...please make sure from your lawyer...

Cororate tax not paid - Urgent I-140

Hi,

My company is NJ based, They had a small office in DE where they filed my labor in Aug 2003. Backlog Labor of mine just got cleared.

Now my company has closed the office in DE so my lawyer is suggesting me not to go ahead with I 140 for backlog case of Aug 2003.

My lawyer is suggesting me to go ahead and file a brand new perm case from NJ where company head quarter is based. I am not sure what to do. If I go head with new perm, I will loose my backlog date.

They say that there are chances of rejection for I-140 and I have left it up to me to decide about it. My company had not paid corporate tax from DE instead they had paid NJ corporate tax.

Please let me know if I can go ahead and file I-140 from NJ or else what can I do?

need help for determining the priority date. my labour was filed in april 2001. I changed my lawyer in june 2003. The new lawyer told me that the labor was filed under a closed corporation. By talking to the employer found out that he had started a new corporation and was ready to file my lc under the new corporation. The lc was filed under the new corporation and I was told that my PD was preserved. The lc was also filed as a RIR since the earlier was was a traditional case. I recieved my lc certifaction om the 23rd of september 2006. now wht is my PD. My lawyer says that it is still 2001, but the certification letter says application recieved date as june 6 2003.My question is how can one capture the PD. Since i am from india can not afford to miss my PD. Would be very grateful if someone can help me.
