Urgent - Question on AP

Hello All,

Is it true that if one has a pending AP petition with USCIS, he/she would not be able to travel outside the country ? till it is approved even though the H1 is still valid ?

Its totally wrong. As long as you have a valid H1B stamp, you dont need to wait until your AP gets approved for leaving USA.

The question arises only when you have already started working on EAD and you need AP to re-enter and incase you dont have an approved AP before you leave US, then you run into problems/issues and even denying your immigration status...

thanks for your response , does the H1 visa stamp on the passport needs to be valid or having an approved H1 B petition does suffice ?
 
In your case, you'll either need a valid H1B stamping on your passport or your AP (approved document) to re-enter USA.

No, an approved H1 B petition is not enough... you do need a valid stamp, or an approved AP document.
 
I guess you can get it stamped at a consulate in your destination say Chennai.
