I have a urgent question. Gurus please help
I work for a small company (just a start up ) . There are about less than 50 employees and company is filing for 3 people for I-140. My lawyer is telling me that if we all file for I-140 then there are high chances that we would get RFE on company's ability to pay. And he also told me that if we really insist we can all apply and then withdraw the case if RFE happens.
I am really not getting the logic behind
1. why more people applying would raise the chances of Ability to Pay
because technically somewhere they have to tell how many people are working for the employees right now. so whether company is applying for his GC or not should not make any difference
2. If we apply then , How withdrawal at later stage would resolve other people's I-140's ability to pay.
