Hi Friends,

My company "liar" forgot to add the keyword "equivalent" in my LC application and in the ads for the Educational Qualification requirememts during the LC process.

The Ad reads: BS in Computer SC. or Engineering.
and I have a BE dgree in Electronics Engineering.

What are the chances of I-140 rejection due to the lack of the keyword "Equivalent" in my LC application. Will They accept BE degree for BS ?

Has anyone got his/her I-140 approved, can this mistake be corrected after LC approval ?

Really appreciate your response. Thanks in advance

What does your education evaluation say? INS strictly goes by the language used in the LC for education and experience requirements.

Thanks for your reply, lcauser.
I have a 4 year BE (Bachelor of Engineering) dgree and my educational evaluation says that, my degree is equivalent to any BS degree from any US university.
but that's not the problem, the problem is that our attorney forgot to mention the keyword "equivalent" in the LC application and ads.

My degree is equivalent to BS but not BS, will that be a real problem, has anybody run into this sort of issues.

HELP REALLY APPRECIATED !

Thanks for the response...but ...

Thanks for your response.

Actually, My degree is a 4 year Bachelors Degree and per the educational evaluation is equivalent to a US BS Degree.

My questions is, do I still need the key word "BS or Equivalent" in my LC application and in the Ads ?

Please suggest.

Much obliged !

Same Situation

I 140 RD 07/09/2003 Waiting

My LC Sub says :

Minimum education: BS in CS, Eng, or related field

I have a BTech (4 year) from India. But I am taking it easy on this one because what you and I have IS a BS degree. There is no 'equivalence' required (in my opinion) if BS is interpreted as a 4 year Undergraduate program.

I looked at the thread mentioned earlier and the issue there seems to be :

LC says BS (This must be interpreted as a 4 year degree) or equivalent .
Applicant has 3 year Bachelors. He wants to combine that with a diploma in a Computer course to match the 4 year BS requirement. There is a need to establish the 'equivalence' here.

All said and done if CIS decides to play on words, they can reject any application.

Cheers !!

I agree with Malsa. If you have a Bachelor of Engg in Electronics, it is taken equivalent to BS in US. No need for any educational evaluation in my opinion.
