I am going to complete my H1 6 years status with in couple of days Can I able to stay in USA as

1. My Husband has new H1 , can I become H4 and stay as dependent in USA?


2. My new born baby is citizen, Can I become guardian to her and stay in USA ?

Please let me know the possibilities of staying in USA in my case.

H1/H4 Visa have max stay of 6 years. You can apply for extension of H1 if you LCA for GC was filed before the completion of 5th year of your H1.

1. My Husband has new H1 , can I become H4 and stay as dependent in USA?
You cannot be on H4 if you have completed 6 years of H1 but can stay on H4 if your husband's H1 is based on 7th year extension .
Check with some lawyer for full details.

why don't you file for 7th year extention yourself? it's a bit hassle, since it's only valid for 1 year, then you will need to file extention again for another year. But if you are waiting for 485, it'd be ok.

Only option is 7th year extension or EAD if you also have a I-485 pending. EAD only if u need to work, else pending 485 will keep u in status.
