I submited the I-140 (Alien with extrordinary ability) by myself and still waiting for the approval. Right now, my company is in very unstable shape and I could lose my current job at any time. I got several questions: ( I still have not filed I-485 and I-765 and my current status is H1)

1. Can I change my job now. If I change the job, do i need to resubmit the I-140?
2. If i submit the I-485 and I-765 and get the approval of I-765, can i change the job immediately or i must wait for 180 days before i change job.
3. If i am laid off, can i change my status to B2. (gvie me more time to find a new job)

watch your back, from your posting i came to know that you have filed by your self and that to in ailien with extraordinary ability.

INS requires very sounding documents for this to prove. May be you are having them. I have cme across a case whose 140 was denied even though he has got many awards fromNASA etc.

I am not sure about your other things, talk to a ttorney.

1. No you cannot change jobs. Unless the new company does a H1 Transfer. After that you may have to start from Labor onwards unless the new company has an approved labor certificate and it matches you job description

2. You can submit 485 and 765 but you will not get approval of 765 since your I-140 is not yet approved.

3. Not sure... Maybe. Plus who will sponsor your B2? Best bet might be to transfer your H1 once you find an employer.

Pls. consult an immigration attorney. Use at your own risk.

I think you can change the job once you apply 485. You don't need to wait for EAD, transfer your h1 to new company.
Only risk in this case is , you shouldn't get the decision on your case before 180 days from the receipt date of 485.

you can change the job

For EB-1A, you sponsor yourself for the application. So you can change the job with transferring H1B or after you get EAD. 180 rule does not suitable for you. You are totally free.
