Urgent- please help!

We are currently on H1B and my husband won DV2009.

His grandmother passed away last week and he is flying back to Germany TOMORROW. We just realized that he may not be able to come back since we are in the process of applying the GC (we chose CP)......

Does he need to fill any forms before?

This does not affect your application at all.

Your Husband can travel and come back ,he is still on H-1b, and he is still in status , all he needs to do is buy his ticket and go to Germany and he will be allowed back with no single question asked.
 
Thanks so much Zimbabwe. Do you think we have to notify our lawyer? We didn't inform our employer when we won the lottery and our H1B lawyer didn't know anything about our DV. We want to keep it totally secret......
 
You do not even need to inform your lawyer, even your employer.

Its like saying i have won a $million dollar lottery , no need to inform your lawyer or employer , they do not necessarily have to know, its your private life and keep it that way.

H1B visa is a dual-intent visa anyway. Having a H1B visa means that you have an intention to stay in the U.S, and since the DV visa has also has the same intent, it shouldn't be a problem.
