I've copied my previous post in this website here for a better understanding of my situation: " Can H1B be filed with current status Pending H4?
My F1 grace period is almost ending. I filed the change of status application to take H4 status and I have received the receipt for it. It says it takes about 100-150 days for the decision. My employer is going to apply for my H1B on April, 2006 and I think I will not have the H4 approval by then. Is it possible to apply for H1B with this pending H4 situation? I am concerned since my F1 grace period will end in a week. Will there be any problem at all?"
-----------------------------------------------------------------
Now, my employer has received a request from USCIS for additional documents (given below) in regards to my H4:
1. I-94 for her last entry into the United States.(the one we have is for 2000 and your I-20 shows a stamp of 2004) --- I drove to Vancouver, B.C. from Seattle with my husband on Sep 9, 2004 and re-entered U.S. (Seattle) on Sep 12, 2004. I was not given any new I-94. The immigration officer checked my I-20 and asked the reason for visiting Canada; that's all.
2. If you did not get an I-94 at the time, what was the reason why it was not issued? --- I am not aware of the reason why I was not given a new I-94.
My question is, was I supposed to get a new I-94? If yes, then why didn't the immigration officer give me one? What would happen now? Is it going to affect my H1B application as well?
Please help. I am in lots of tension now.
Thank you.
