My wife got non-availability certificate from her birth muncipality and 2 affidavits from parents !! I send all docs to lawyer to file my 485 ..The affidavits WERE NOT ON STAMP PAPER but plain paper signed by parents...Lawyer says that if the affidavits are not notarized I will get RFE ...My dilema is her parents are in SINGAPRORE and will go back to INdia only after 1 month.....what is my option now ?

1) should i tell lawyer to file 485 ( so that my ND/RD is sometime in Feb !! and thereby pass 180 days asap before my comp lays me off !!)
2) wait till her parents get back to INdia ( man i dont want to do this !!)
3) IS THERE ANY WAY I CAN GET THESE DOCS NOTARIZED IN USAA??

Please help !

Apply for I-485 as soon as possible. It will be a long time before you would get any RFE\'s. In the meantime when the parents get back to India Get their affidavits on Stamp paper and have it notarized in India. When you do get the RFE submit copies of the affidavits. Consult with your attorney on this. In my opinion there shouldn\'t be any problems.

Thanks VSCRD1199 !! I think I will ask my lawyer to apply I-485...since I am the primary applicant my processing will continue while my wifes application might get an RFE ? right ?? also I have read some sites which say notarization is not required ...www.immihelp.com doesn\'t say it has to be notarized ..any thoughts?

If I were you....

If notorizing the documents here adds any value, I would do it and apply for 485. If the attorney says you need to get the documents notorized in India, I would get them later. In the meantime I would apply for 485 NOW.

Good Luck.

Finally this is what i did...I talked to my inlaws in Singapore last night and told them to get the afffidavits notarized / attested..They went to Indian Consulate at Singapore same day and consulate officials said they attest affidavits for a fee...they paid the fee and will get the affidavits attested by Govt Of India next day...then they will fax them to my lawyer in Chicago...I talked to my lawyer and she mentioned yes that should do the job !! Hopefully i wont now get a RFE.....Just an FYI for people who wants to get documents attested by Govt of India outside India ...
