Urgent! Please Help

Laid off right after submit RFE
140 approved 11/2002
485 RD/ND 12/2002
Got a new job in 8/2003
Now I recieve an RFE asking for 3 years petitioner's tax return, annual report or audited financial statement. W2, federal tax returns, 3 recent pay stubs, EVL.

First I am not sure if I am eligible for AC21 or not. If yes, I should submit which company's tax return documents, my current employer's tax return or previous employer. Actually my previous employer already confirmed they wont give me those documents. Will it work if I submit current employer's tax return only and tell INS that the previous employer doesnt want to disclose financial documents to former empoyee. Do I need to tell INS the date when I left the previous employer?
