Hi All,

I have applied my i485 in Jan 30, 02.

My First Question is that:
A. What's the expected time of approving Wac02099 cases?? What are the chances that INS will start handing these cases in 2004 Or sending RFE in 2004.

My Problem is that:::

I just received a contract job of one year, which is not a permanent offer. Company is not ready to hire me. That Contract job is in very big company.

My Problem is that if in case RFE comes,
1. then how will I provide EVL, W2 as I dont have any Permant company.

2. What should I do in that situation.

3. If one is not working in any permanent company, and RFE comes related to EVL and W2, what's worst INS can do in this situation. ???????????????????????????????????

4. Is it also possible, if we dont provide them EVL and W2, then INS can reject our GC.????????????????????????????

Please suggest me "Should I join this contract job of one year in big company, having no permanent company.""

My 2 cents.
A. You can expect RFE in 3-6 months from now going by the current rate.
You definitely be ready to provide EVL, paystubs, W2s to expect GC.
Just make sure that you will have atleast EVL and current paystubs by the time RFE comes. Also, make sure u r doing similar job as mentioned in LC application.

Are there any risks in GreenCard, if I dont have any Permanent Company?

Can INS deny my GreenCard, if I cant provide them EVL, Pay STubs and W2??

possible solution

one possible solution might be to go thro some consultant or preferred vendor of the company and u will need to give them a cut from ur hourly rate...but this way u can be on their (vendor's) W2...u cud try to make sure the vendor co has been showing steady income...

this is just an idea...
 
my 2 cents -

From what I know - GC is for a future job offer and a pmt one, so that you can fend for yourself and do not become a public charge.

When they adjudicate your case - they will ask for proof of current job and salary (like EVL, W2 etc) to ensure that you will continue to have the job after the approval (not that it proves anything, since you can lose your job a day after you get your approval and file for unemployment) but nevertheless.

IT is important that you show yourself on the payroll of some company when you send a reply to your RFE.

You have been offered a contract - can't the client do a corp to corp deal with some body shopper? You may get less salary in the process but then you can get an EVL and paystubs and be considered a full time employee.

Also what is your job status now? are you employed or hunting for a job? Becasuse in case you are looking and you do join some body shopper then you can use AC21 to port your process.

Bottom line is - you cannot work as an independent contractor - as your primary job. You have to be on some companies pay-roll.

Number of companies which offer that service, viz - taking a cut of your salary to keep you on their payroll and at times paying for your medical insurance to boot. Should be easy to get one.

You certainly need an EVL and paystubs from a company if RFE'ed!
 
I have a workaround it may not be an ideal way to go about it but its a solution neverthless.

1) Take the offer and join the company as a consultant( I am assuming the company does not want you to work through another company ). Lets say you make an equivalent of $80 k a year .

2) Join a consulting company in parallel using EAD as a full time employee. You pay them the 80k and they pay you 70k back and keep their cut. Once you reply to the RFE .. close the matter.

This is a workaround , you will be double taxed . wac 02-099 you can expect the RFE in 3-4 months .

Actually the problem is that company is neither hiring me nor agreed on doing corp-to-corp.

I am confused that this consulting company(Company 1) is placing me for one year contract project in One of the biggest Company of USA. I am confused or little bit greedy that might be after 1 year, that big company will hire me as a permanent employee. I have a great chance now in working with good Software Company, but I am feeling helpless to take
the decision because of GreenCard.

My problem is this 1 year. What if RFE comes. Because if I start doing this direct contract, then I wont have any Permanent Employer.

Your solution is pretty impractical not to say illegal. The only winner would be IRS. It will be extremely difficult for the consulting company to justify the 80K influx of funds for the year without a known source of income. The easiest way would be offcourse to work for a small consulting company that agrees to split the money 10-90.

As far as gc_cal's situation is concerned, the water keeps getting murkier and murkier.

Can you PLEASE rephrase your question clearly and succiently so people can understand it enough to answer.

As far as I can understand from your first post:
1. You are offered the job as a private consultant with Company X
2. You don't have a GC, but are close to getting one.
3. You are worried about replying to a RFE.

As per your latest post:
1. You are working for Company Y which will place you for 1 year with Company X
2. After this one year period you have a chance to work permanently with Company X.

Which of the above scenario's is true? Or is that both are false and there is a third scenario? Please remember the accuracy of the answers totally depend upon the explicit nature of the question with all of the background provided.
