Urgent please help - Irresponsible civil surgeon

I am applying green card for my parents. We went to this "USCIS civil surgeon" in my area on July 3.

My dad's TB skin test came out positive so we went for Xray. Xray came back with abnormal result. This doctor told us if we do CT Scan, they could dignosis what it is. But after we spent like $650, they still can NOT tell us what it is and tried to make us do Pet scan ($8000). We refused that and decided to go to Department of Health.

After all sputa tests came back negative, Doctor at Department health put the dignosis on form I-693 "NOT consider to be infectious". My dad is going through 4 months preventive program and taking medicine.

I went back to this office. This civil surgeon signed the form but checked my dad as "class A" which is TB, infectious. We argued that it is not right. But this civil surgeon refused to check the regulation and told us that we could file I-693 to immigrtion.

First of all, this is wrong diagnosis, second from USCIS/CDC TB guide, if class A is checked, civil surgeon should NOT sign the form until the 6 month TB treatment is done (which my dad is only going through 4 months preventive TB treatment).

Cite from the instruction: "Applicants diagnosed with Class A pulmonary TB disease must complete a recommended course of treatment (minimum of 6 months) before the civil surgeon can medically clear them for TB for the purposes of USCIS."

Also, this civil surgeon made my dad signed the form the date of checking out TB skin test result (July 5), which is about 8 weeks ago. From the instruction of I 693, my dad should not sign the form until this doctor gave her diagnosis (August 27).

Cite From the instruction "After the medical exam (and any follow-up if required) is complete, write the results in Part 2 of the Form I-693 as they relate to the specific component of the medical exam. The applicant should sign the certification in Part 1 and you should sign the civil surgeon's certification in Part 5."



Also, my parents did medical exam on July 3, at that time, they still fell in 30 day grace period to avoid Zoster vaccine. This doctor tried to charge us $360 per person for the shot. I tried to argue it so she put "refused" on my parent's vaccine record. I think she/the office just tried to make money on us immigrant.


I went to this office several times and tried to talk with the doctor about these issues. The manager of that office told me that I have to pay $76 to talk with doctor. They insisted that the form is completed and ready to be filed. I know this is NOT right and will be reject by USCIS.


So please help us out on this issue. Any input will be greatly appreciated.

Do anyone think we could suit this civil surgeon for misconduct? How can we contact USCIS to file complaint?

This medical exam really delayed our file for green card so please help.

Your father has TB. Your concern should be treatment not criticizing the doctor. The delay in filing for the green card is a minor problem.

The civil surgeon likely has a different standard than the Department of Health.

By the way, my grandfather died from complications of TB. TB had virtually been eradicated from the US until recently. Treatment of all immigrants is essential to return the country to that state.

what sort of statement is this buddy?. Are you saying that all immigrants should be treated for TB?. A lot of immigrants are not active TB carriers.I am assuming you got this worded incorrectly:)

With regards to the case here: you should do a thorough check up and defend your case. you should be able to find another doc and review the case.

My father is NOT TB (he had this BCG vaccine when he was in China). He is suspect of TB, that is why he is only taking 4 months preventive treatment not 6 month TB treatment.

The doctor at Department of Health told us that we should be carefully about my father's abnormal lung condition and we will get him checked up in about 3months with lung specialist as recommended by doctor at Department of Health.

This immigration civil surgeon never care about my father's health, all they concerned is Money and gave this bogus diagnosis.

We will file complaint with doctor board at Department of Health. And we may have to find another civil surgeon to get another form.

If I were you, I would find another doctor and explain the whole situation BEFORE taking another exam. Eventually you might find someone willing to understand you father's complicated situation and fill out the forms correctly. Some doctors also charge a lot less than others, so shop around a bit.
 
OP stated that his father is being treated for TB - even if it is a preventative course, it is suspicious. He needs to complete the treatment before worrying about any other course of action. Compared to what others experience, a 4 month delay is like the blink of an eye.

The OP really needs to rethink bringing father to US. With this as a pre-existing condition, health insurance will be nearly impossible to obtain. His father cannot become a public charge. OP should be prepared to assume large - no, make that enormous - medical expenses.
