I have an urgent travel to India next month and also have to get my visa re-validated at the Chennai consulate. Meanwhile, I'll be applying for my H1 (and spouse's H4) extension next week.
- Is it ok to have a pending extension when you travel outside the country
- What happens if the H1 approval comes in before I come back. The I-94 in the approved H1 will be different from the one I get after coming back. Will this be a problem.
- Can I ask my attorney to mail the approved petitions (H1+H4) to India so that I can the stamping for the new extension too.
I know I can do the premium processing to get the approvals before I leave but would like to avoid it if possible - pretty expensive.
