I need your help as I'm extremely tensed. I'm single & was planning to get married this month. My priority date (EB3) is June 2002. I'm from retrogression affected country (India). The retrogression cut-off date for Mar is currently Mar02. Also my FP1 was expired 3 months ago & I should be getting my FP2 anytime.
But I'm worried that inspite of all this my case can be approved ANYTIME as we have seen many exceptions & surprises earlier when your case is approved unexpectedly. My problem is that I was rushing to go to India & get married "before" I get my green card & bring my wife here on H4. But I just checked online that waiting time to get an appointment in Delhi embassy is "64 days"..The latest date I'm getting appointment is 17th May which is soooo far off & I may get my Green card approved before that day UNLESS I get my FP2 which I'm praying for...as I can delay giving my FP2 until I get married...as they can't approve my case without my finger prints...
Now the QUESTION is...
1> IS THERE ANY WAY I CAN GET AN EARLY APPOINTMENT AT DELHI EMBASSY..
2> If I go & get married & come ack to US...can I file my wife's case while she is in India...I know u need to be in US to file for 485...is there any other way out....

PLEASE HELP me OUT!!

Most Important: Get married BEFORE your GC is approved.
If you get approved after getting married and before applying for your wife, you can do Follow to Join. Look at the Follow to join I-824 forums.

I would suggest get registered married ASAP.

Good luck.

I don't think this is true. Follow on join is for couples who are *already* married but the dependent did not file for GC before primary's GC was approved. If the dependent is already landed in US, there is a grace period of 180 days for applying for AOS after the primary has been approved, but all bets are off if the dependent is not in US at the time of approval.

Isn't that what I said? "If you get approved after getting married and before applying for your wife, you can do Follow to Join."

Isn't Follow to Join if the spouse is outside the country? If the spouse is already in the country, you have to do I824? and I485 (thats what my lawyer told me).

What happens when spouse gets here on dependent visa say H4 and before applying for his\her 485, the primary's gets approved. What would be the spouse's status in the interim (Primary's status got converted from H1 to GC)?

Where does it say 180 days? The reason i ask is I might be that scenario down the line so I would like to know what the laws say.

Thanks.

CP requires current PD, Follow to Join requires approved GC; so it is a dicey situation.
Here is a long thread from murthy forum
