Urgent!! Please give me some advice!!

My situation:
*My I-485 case (WAC-02-042-5xxxx) at CSC is still pending after EFE replied on Nov. & received on earlier Dec.
*My EAD will be expired on end of Feb, but the renewal (receipt date: Dec. 7th, 2002) is on pending.

Severe Problem:
I was just laid off with NO REASON by my employer on Friday.

Need Help & Suggestions:
1) How soon do you think my case may be approved if I am lucky?
2) Is it normal for an employer to notice INS the employment-termination?
3) I am going to get my IEAD, but I will have about a week gap between the old and renewal one. It will be a problem? And, for my situation, what the Severe Problem I am facing if I go to the local INS for IEAD and what documents I need bring with me?

1) No one can tell
2) This depends on your company policy. Before INS started getting into trouble, employers just ignored to send H1 terminations, but now they are doing this. It is best to contact your lawyer (the one so far) and ask if this is being done.
3) EAD doesnt bestow any status. AOS application does. EAD can be used to prove status though. So keep a copy of the 485 reciept and if your lawyer is benevolent, a copy of the filing and find a new job. To get iEAD, take old EAD, the renewal application that would include the 485 receipt.

I agree with all Neeru says...

Just wanted to add on #2 - You can discuss with ur employer if they can keep u on leave without pay or something like that, until ur GC is approved, you could try it...

I know friends in big companies who have done that...Of course, in their cas,e they were being given severance package of a few months...they forfeited that pkg to stay on...

I will very appreciate it if someone may advise me the requirements from INS regarding the new job title and salary? How same or difference between the old & new one could be (like manager or engineer)?

Since you've had an RFE, I wouldn't worry too much about the job title. The chances of getting a second RFE are very low, you should just get your approval (who know's when). I would guess that you're case is already processed and approved but waiting for what ever is holding CSC back to be lifted, then you will receive your approval.

I wouldn't worry, just get a new job and your GC will turn when CSC is good and ready.
