Urgent ,,Please clarify..!!

I got my I-140 approved on 03/11/02..just called up NVC to check status and got the message that --""an information sheet concerning "adjustment of staus" has been mailed to me and I should complete this "form-letter" and return to NVC.""
Does this mean that my case is now "adjusted" as against CP (what I had opted at the time of I-140)...do NON-CP cases go to NVC at all??? do CP cases get a similar message???..I\'d really appreciate if someone could give me the clarification on this.

I received the same message.

Most probably is NVC asking us for reconfirmation letter that we want to go through CP and not through AOS.
 
Did you have an attorney

I read somewhere that it happens if you have not signed a G-28 for appointing an attorney. I am not sure.

Khalas.. Whats your 140 RD at TSC ? Someone mentioned that if your 140 RD is before Oct 2001, they send out that reconfirmation letter. Its still relatively new developments so we need to keep ourselves posted.
 
Well this is a new step that has been added by NVC and is applicable for cases that reached NVC ...

after Mar15th or so (Approx) ... WatchTSC had some experience with this and has posted it in one of the discussions .... its nothing but a reconfirmation letter from u stating that u are wanting CP and not AOS ....
 
According to AVM NVC sent a letter to my attorney on 4/13/02.

My I-140 RD is 2/4/02, I-140 AD 3/13/02 and NVC RD is 3/27/02.

This was the NVC practice several years ago. It stemmed from the fact that people were filing both applications. About a year and a half ago, they stopped asking this question. I guess the number of people filing both applications has risen to the point where they feel it necessary to ask again.

Does this mean that if the dates were to retrogress and u have signed such a letter ...

you will not be allowed to file 485 ???

I mean the priority dates come out on the 10th for the next month ..so if dates are retrogressing, u have 20 days to file for 485 ...will one be able to or not under this new procedure??

I dont think that\'s the case. You can always change intent. I guess the NVC is seeing that they are creating a lot of P3\'s while people are filing 485\'s behind their backs and not returning P3\'s. But there is nothing (as of now) to bar you from filing a 485 at anytime during the process if you desire.
 
I just talked to NVC regarding this

I was told that I have an attorney and in my case there will not be any form except P3 sent out, she mentioned \'Agent of choice\' form will be sent out when there is no attorney representing. This form seems not to get confirmation regarding CP or AOS. Just to verify that if there is no attorney then you are representing your self and you are giving correct address of communication etc. I think lot of guys are posting mis-leading information. This is eventually making every one confused. The NVC operator specifically told me that my attorney should expect a P3 (old name) new name some \'Instructions packet\' or some thing like that. And she also told me that it should be within 4 to 6 weeks and I should fill out that form and send.

I concur. Thats exactly what the operator told me today. The NVC operator verified my name and told me that my P3 will be mailed to my lawyer\'s office (he had the name and told me himself). He said that I dont need reconfirmation but you still never know :-(

Prasadk, did your 140 (for chennai right ?) finally reach the NVC ? What happened to your attempts to AC-140 ?
 
Checked up with my attorney and she told me that she has sent the confirmation..

to NVC about my intent to do CP...so I guess the issue should be resolved..however,I think it would add further delay in case creation and P3 processing at NVC.

Anyhow,thanks everyone for sharing your experiences and providing the clarification....I really appreciate it!!
 
It reached on Apr 03 after 2 months

I sent packet to Mumbai after some good information from v7 and bbhaskar. They told me that Mumbai seems accept AC140 even if I-140 accpetd for CP. I was little bit skeptical as the both were Mumbai. My case is different in that perspective. Nevertheless, I sent packet with confidence and waiting to hear from them. May god bless me.

On the other end, I requested NVC to give me BMB case number, they accepted they gave me BMB number. (My I-140 is accepted for Chennai) Now my best chances are with AC140 at Mumbai. Hope it will be accepted. Otherwise I need to worry about I-824 and pull that I-824 petition back, it might cause any problem in future.

another question / point to ponder..!!

Guys,the fact that NVC is asking us for reconfirmation...is it safe to assume that NVC has received the case from the regional INS office???...or they could do that prior to receiving case...does anyone know as to how long it might take after you reply to NVC??..also does some one has some rough breakup of time frames...just an idea would help..!!!
