Urgent!!!!!PERM Pre approved labor EB 2

Hi Guys,

I have applied LC EB 2 (PERM) on 08-16-05.The status is in process.It is still not certified.Even though if it is certified before sep 30.Can i apply for 140 and 485 with out the copy of the certification?

What are my options now?DO I NEED TO WAIT FOR THE PERM EB 2 TO GET CERTIFIED OR ELSE DO I NEED TO APPLY FOR 140 AND 485 WITH A PRE APPROVED LABOR.CAN ANY ONE SUGGEST ME ON THIS ?

I need to decide very fast i have only 2 weeks left.Can any one suggest where can i get pre approved labor?

You need a certified labor

I wish you get the Gc without any application work, since you are so eager to get it. Pun intended.

Ofcourse you need the certified copy of labor. Even if it is approved labor. Still that approved labor must have PD older than 1999 date.

To get approved labor, you might try ebay.com ....that is the only place I know sorry.

You are talking about exactly what happened in my case, my labour was approved on 14th Dec 2004 and dates were doing to retrogress on Jan 1st 2005. But the certifying officer who approved my labour went on vacation after approving my labour and did not come back until after Jan 1st and mailed the certified labour on Jan 3rd.

Because of that I could not file 485 on time and could not get EAD so that I could use AC21. We even tried to send the 485 without the certified letter but USCIS sent the whole package back. You can see my signature to understand the dates. Good luck and hope you get the certified letter before sept 30th

Did you attach the approval email or some proof of approval

Hello Saurbh_tulika,

How did you find out your labor approval before getting the hard copy?
If you got an email or some other proof, did you attach the email copy with your I-140/I-485 petition.

Please let us know, what proof you gave it to USCIS for labor approval.
