Urgent:Out of status if I filed for EAD and my H1 expired??

I'm currently on H1B. My visa expires on 6/30/05.

I filed 140/485 in July 2004 and received I-140 approval in Jan 05.

I'm going to file for EAD and I want to know if I would be considered 'out of status' if my H1B expired and my EAD was not yet approved. There is a chance that the VSC may not process it before the H1B expires

Would the receipt of the EAD filing be enough to keep me 'in status'

EAD has nothing to do with your status

It is just for employment. Note if you have EAD application pending for more than 90 days you can file for interrim EAD in your local office

If H1B expires, you will be out of H1B status but your stay is legal as a 485-adjustee. You will have to stop working until you receive the EAD.
