In Jan 2002, my visa status changed from F1 to H1B. After 2 weeks, I will be going to India for the first time since I got H1B approval notice. Hence, I will have to got to the US consulate for an interview in order to get my H1B visa stamp in the passport.
Th problem is:
Since I got promoted in April 2003, my job title & salary now are not same as that in the H1B visa petition filed for me by my employer in 2001.
My employer says that he will have to file for new LCA now.
1. Please let me know whether this is the only valid solution.
2. How long will it take to get LCA?
3. Does my employer have to file for amended H1B petition?
4. Also, will this affect my H1B stamping case in any way ?
