Hi,
My In-Law expired. my wife or both may need to go to india. Our H1 visa has expired and we are on EAD, AOS approval pending. 1. How to apply AP and how long will it take?
2. If we go to local INS office and apply for AP, what proof should we submit in this situation (as there is no time)?
3. What documents should we take to local INS?

I am really sorry to hear that.

Since your case is genuine and you need to go temporarily out of US immediately,just go to the nearest USCIS office and explain your case. They will give you an AP immediately (maybe on the spot or in one or two days).

Sorry to hear that. As sai and ar888 pointed out, you can get the AP on the same day from your local BCIS.

1. They will issue it for one year
2. No (as long as you return before the expiry date).
