Urgent - Need Help

Hi,
Asking this question on behalf of a friend.

He is working for Company A on a H1 B visa. His 6 yrs limit on the H1 is coming to an end soon and his labor is not cleared as he was laid off from Company A. However, he has managed to get a H1 transfer thru Company B.

My question is how can he get an entension on his H1 B.

Please help
 
From what I understand, at least your LC should be cleared or in process to get an extension beyond six years of H1B. If eligible, company B should be filing for the extension.

Thanks for your reply. What do you mean by in the process. He has already been laid off while is labor was pending.

Also have u seen such cases in the forum before.
 
LC being in process is good enough for 7th year extension- it does not have to be cleared. The requirement is - 365 days have passed since filing of the labor certification or immigrant visa petition.
This means the LC must be filed before 5 years of H1 are over.
