urgent- need help to return US

Hi

I am a Nov. filer of 2001 for I485. I have AP, but don't receive my renewal EAD which has been approved. Now I am travelling outside of US. I plan to return US on this Wednesday, and need help to return US withour any problems. Thanks in advance.

1. The whole lower part of my current I797 was taken off when I departed US. I know that I94 should be taken off. But the left lower part was taken off too. Now I only hold the upper part of I797 withour any sponsor's name. Is it normal? Is there a problem when I return US?

2. Although my renewal EAD was approved on Jan.03, I don't receive it. Will the US officer ask about it?

3. If I get a new I94 card, which date will be stamped on it? The expired date of my AP or I797's?

There might not be any problems in your case

As long as you have a valid H-1 (797) or an AP, you can use one of those while coming back. I don't see any problem for you at the port of entry.
 
My guess is that you need to have the new visa stamped on your passport, OR if the existing visa on your passport is still valid OR if neigher use AP.

--- You should not have any problem

--- if you are using the AP then probably the officer may ask for it. I am not sure on this. But if your H1 is still valid and you did not use your EAD to work here in USA, then don't use AP. Hi is sufficient to come back.

---------- If you use you H1 then expirey date of H1, if AP then expiry date of EAD.
