If I have 5 years experience canI file under National Interest Waiver ?
I have 5 years including current employers.

I am a BE Computer Science graduate with 5 years experience and working here for the past 2 years. I am working for the current employer for the past 1 and half year and he is paying me 58K. With this will I be able to apply for EB2 ?

You are most likely only qualified for EB-3, which always requires your employer's help. Priority dates for EB-3 is currently an issue if you are born in India or China and, according to Carl Shusterman, is about to get really ugly for everybody else this summer as the new LC process means the USCIS is absolutely flooded with applications.
