Hi,

I work for a desi consultancy with Jobs in UK, USA and India.

I lived 2.5 years in the usa during which my company applied for my green card. When i left USA they applied for consular processing with I824.

I824 has now passed through and i have a PD of dec 2001, EB3.

Now i am working for the same desi frim in the UK on deputation.

In the UK i now have a offer to work with a big firm and thus leave this desi firm.

If i leave this desi firm, will i still get the green card when my PD becomes current ?

How or where can i find the details ?

regards

According to my lawyer if the company applied I-140 for anyone there is no way they can take it back.
The only problem will be that you have to show employment within USA. It may be any employer if you get your EAD or you need to get letter from your desi company.
Hope it helps.

Ok that is clear now

The only problem will be that you have to show employment within USA. It may be any employer if you get your EAD or you need to get letter from your desi company.

Even for consular processing i will have to show emplyment in the USA and also i will get EAD ?

I am not currently in the USA and i guess since my H1 has expired can, i enter the usa any other way than my PD becoming current ?

Please help me understand this key issue in my current situation.

Let me re phrase the question

For consular processing, with PD of dec 2001, for a person who is currently living out of usa, can i change the employer that applied for my green card ?

please help me out !

GC is for future employment

and so yes you need to show a letter from an employer stating their intention to hire you back in USA or keeping ur job in USA waiting for you.

Thank you so much for your answer,

Should this letter be from the same employer or can it be any other employer in the usa ?

Regards

Guys,

Can i have any other US employer(since i have left my original US employer), send a me the letter stated above if i am in consular processing and living outside the usa ?
