My H-4 to H-1 was approved with my maiden name (as it appears on my US visa stamp) on the I-797 and I-94 instead of my married last name (which is in my current valid passport as well as in my H-4 extension.
- What is the procedure to correct the name in the H-1 I-797 and I-94? and what documents (affidavit, etc) are needed to do so ??
- Am I eligible to work until the error in the H-1 I-797 and I-94 is corrected? If so, can the employer pay me using my tax id number (ITIN) because I cannot apply for SSN now?
