Urgent..Missed on FP Deadline - Never receievd the notice....

Hi, Today I just came to know that I missed on the FP Notice that they sent out to my old Address (even though I updated my address to INS - called them up and also filed AR-11). Even the lawyer says he receievd it today even though the appointment day was October 25th. Experts please suggest as to what are my options --- what should I do??? I need to know my options on an urgent basis --- as I am afraid of my I--485 getting denied because of this....
 
Experts.. please help me on this.. I have seen cases on this forum where if someone misses there FP appointment then their I-485 Application is considered as abandoned and gets denied, even though ther person is not at fault. I do not know why I did'nt received the notice.. but how can I fix this now --- Can I just go to the center (I have a fax copy of FP Notice) and shoe them the fax copy of the FP and ask them to take my FPs? Or what other alternatives are there?

Also I would like to know when one received the new FP Notice (after the old FP expire) then can one safely assume that the security checks are cleared or there is still long road ahead...?

Experts please suggest...

Take the old FP notice and go to the ASC.Explain the situation, they would consider and take your FP.Generally Wednesday and Saturdays are walkins.

Generally, your attorney would also get another copy and try to get that back to you as soon as possible.

They do not abandon the application in such a short notice as October 25th is just a week back. I did my first FP two weeks after the scheduled date.

Thanks gcva, but I am thinking of driving down to ASC early tomorrow morning (Saturday) - 6 hour drive and I only have a fax copy of the FP notice that the lawyer received today. So do you think would they accept the fax copy of the notice and take my FPs? Another thing that I am concerned about is that I moved from Boston to Ithaca, NY almost 6 months back - and I notified via phone as well via ar-11 (have the receipts as well) - but it seems that they sent out the FP notice to the Boston address - which got returned back to them - i think that this might have been the case as to FP notice had appointment for Boston ASC when in fact it should have been somwhere near the place I currently live (Ithaca, NY) - like Buffalo, Syracuse etc... Once I go over there should I bring up this issue about the address.. ??

I faced a similar situation just days ago.. they sent me my FP notcie dated sept 29th to my old address in Michigan and then it went back to them and i guess they realised they made a mistake and they sent me the same old FP notice(dated 29th sept and report to detroit local office ) on an new envelope to my current address in ohio. i recd that on oct 23rd. i immediately called customer service and they told me to take that same notice to my nearest Application support center in Ohio and she said they should honor that notice. so i immediately went the next day with the notice (asking me to do in Michigan) and had my fingerprint done in Columbus ohio. i explained to them and they did not ask a single question. infact it went off smoothly. i guess they know USCIS often does this mistake. so i think even if you go to the nearest center you should be fine. I know my other frined moved form CA to GA and she also faced the same thing and she was also fine doing the FP in GA though the address on FP was of CA.
 
one more thing.
also i realised that when i was doing the finger printing in the local office in ohio they had my old address of michigan in their system. they updated the same. i am not sure how their computer showed my old address because i know that VSC has my updated address in their system. (as they realised their mistake and thensent FP to my new address.)


so make sure your address is updated when u go for FP.

But I am planning to go to the old ASC (in Boston) itself that they have specified on the notice (I know it's 6 hours of driving for me one way) but I do not wan't to wait for INS to re-sent me notice (because what if they again re-sent it wrong address - and I am afraid if that happens than they might just simply consider my case abandoned). In the notice they have specifically specified that - "
Please appear at the below application support center at the date and time specified. If you fail to appear as scheduled, your application will be considered abandoned. "

So going to this old specified ASC tomorrow with a fax copy of the notice --- would that be OK??

Please suggest...
 
Hello All, Thanks for your suggestions. I just took the fax copy of the notice that I had and went to the ASC that they had on the notice. They did my FPs without asking anything - not even the original notice.

Good Luck Akash!If your NC is cleared you should be receiving the approval pretty soon!

Thanks AKash! My case got approved on 11/2 and I've got the message on 11/3. I didn't notice any LUD's after last years's FP.
