URGENT: MBA student OPT to H1

Hi,
I am an MBA student, graduating in may 2004 from one of the top 5 business school.
I have a job offer in a large pharmaceutical company X in New Jersey in a " Management leadership development " role.

There is one big hitch howver..Company X has no record of sponsoring H-1s! (they have either hired Permanent residents in the past or transfereed employees on L1)

They are concerned about the follwing:
a) It will be too much of a hassle to get a H1-B
b) What happens if my H1-B gets rejected?

I need some advice in convincing them.This is a really urgent matter, since if I dont convince they in the next few days, I will lose the job offer!


I plan to apply for my OPT now any way (, which will give me eligibility to work till may 2005) and would ideally like to process my H-1 as soon as I join work (August 2004)

Wanted to know:
a) to get my H-1b, what are the things that X needs to do? of the above, how much can be done by myself and how much by an external lawyer?

(The reason is I want to know the least extent to which I can involve X)

c) What are the risks that they need to be aware of (points at which H1-B) can be rejected?

d) Do they have to post my postion? if so where?

I would really appreciate feedback. I am really concerned, since I will lose my job offer otherwise

Large pharmaceutical company m...ck? Most of these companies use consulting companies to process H1. Find out. Although H1 is not a hassle if you have a resident immigration lawyer. If not it is a hassle.
a) you can do everything through a lawyer. Find a good immigration lawyer..
d) they have to post an advt. for your position inside the company.
