Hello,
My current employer is planning to do a labor substitution. It is a EB2 labor (Masters +2 or Bachelors+5). I have 3 years bachelors, 2 years post graduate diploma (combined equal to a US Bachelors)+ 5 years exp. So EB2 is risky.
Spoke with the lawyer. He says I can file 140 in EB2 as well as EB3 at the same time. If EB2 140 gets rejected, then use the EB3 140.
Can this be done? What is the downside? Has anyone done it before?
