Urgent!!! Labour substitution question

Hi all,
My company has a labour which they had applied for another consultant. But that person has already received his GC through his wife....The company is ready to use the labour for me....The labour is not approved but they hope to get it approved in next 2-3 months....Here is my question :
The application was applied in May 2003 with bachelor Engineering and 5 years experience.I am also bachelors in Engineering but in May 2003 I had about 4 years 10 months experience
( I had a 2 months break between jobs). Today I have about 6 years experience. According to the company there should not be any problem to apply this labour for me....But I have read in forums that this can be problematic...Can someone please let me know whether will any problem will be created with the labour substitution.

Your 6 year experience, is that with current Co.... or is it before your join this Co. Because you can not use your experience with the current Co.... :(
 
I joined this company in June 2004.....So do you think this will be a problem...but remember that when the labour was filed in May 2003 I was 3 months short of 5 years experience...
