Urgent! Labor Cert Problem! PLS HELP!

Hi this is my first post here. My employer file a GC peition for me. Today they told me it's been rejected. The reason: my company did not do the recruitment for the whole 6 months. Now the paralegal at my company told me that I have to file the petition all over again. That will take another 5-6 yrs for the whole process. I am desperate right now. the paralegal really screwed things up. And I need advice on how to handle this. My H1 will expire next year Oct.

Is there anyway to get around without filing a new petition?

If there is no other way, should I advise the paralegal to file at another state with less backlog.

you should either try for labour substituion or file labour immeidately this month it self .. you can get 7 th extension .. So try for a company who can file a labour for you ..
follow the forum .. you will find out the way to get rid of this ..Dotnworry .. If you can file a labour one year before your H1 expire you will get one more year extenion ..So hurry up buddy ..

RIR Advertisment Period

Hi

I have a question, how long should be the Advertisment period before applying a labor in RIR in chicago area..
My first start adv started in May ,is it necessary that adv goes on for 6 months before applying Labor.

The best advise is talk to you lawer and talk to your company ..

Actually in my company many people have put there advertisment period for only 2-4 months after that they applied for labor..
and there labor's got approved ..One more question when did you got the labor query is that when your applying for 485 or when you have applied for labor and waiting for labor approval..

you get labour Query in the stages of SESA and FEDERAL .. That means before you file for 140/485.
