My brother is on L1 here for the past two years with employer A. His L1 is expiring in Oct 2004.
He is looking for a new job on H1 with employer B.
He is planning on applying for L1 to H1 change of status.
1. If the H1 gets approved - can he stay in the US or should he travel to his home country to get stamping?
2. Is there any way he can travel to Canada or Mexico to get his H1 stamping.
3. Does this mean that the H1 approval will only be for four years instead of six years - because of the two years on L1 already spent?
