urgent! kind of lost

hi All,

Please help me with my status and what to do next.
here is my situation
1. Filed my GC with company A(consulting firm). after 1 yr moved to company B.
2. Got Second EAD thru company B(perm position).
3. Had to go to india - so resigned company B.
4. stayed in india for 6 months and came back yesterday.
5. company A is ready to take me now and file for EAD extension.
6. MY EAD expires in another 40 days what if i dont get NEW EAD by that time?

And I filed my 485 in August 2002 but is still in process..!!but the date on the website is july 2003.!!Is my application rejected or something? are there any August 2002 filers who did not get approvals?.

Your advice or information will help me a lot!!

In what status did you get back in ?? H1..L1.??? If that is the case, then you dont have to worry. You may remain in your H1 status and meanwhile you could renew your EAD (there is no EAD extension...it is EAD renewal).

Most of the early 2002 filers have got their approvals. There is another ongoing thread here for 2001/2002 filers not approved. Check that..

Since you didn't mention it, for the purposes of my answer, I will assume your H1b, L1, or TN is long expired and no longer valid.

You can file for an interim-EAD if your EAD application has been pending for at least 90 days.

So if you file today, and your EAD does not arrive by the 40th day then you can't legally work anywhere in the USA until one of the following happens:

1) Your EAD arrives
2) You get an interim EAD from the local office on ot after the 90th day.
3) Your I-485 gets approved.

Once one of these conditions is met, you can continue working.
 
I agree with curiousGeorge answers, but would like to point out that people have successfully got iEAD even befaore 90 days of filing. You can try this, apply EAD now and if it is still pending for 40 days, go to your local USCIS office and take a letter from your employer saying your job is based on you having valid work authorization. If your EAD expires and you do not get a new EAD, they will terminate your job. I have seen people successfully getting iEAD's with the above letter, even though 90 days are not up.
